POLICY
The Ainaloa Community Association is a nonprofit 501c4 organization that is
supported solely by the assessments, and fees from property owners, who
constitute its membership. Member dues, also known as assessments,
support the paving and upkeep of roads and easements, the management of
mailboxes, parks, playgrounds, sports fields, buildings, and administrative
operations. The continuing operation of the subdivision is reliant upon
members’ prompt payment of their annual assessments, which are due and
payable by July 31 st each year. When a member’s assessments are in arrears,
the Association will promptly pursue assessment collection in accordance
with the following procedures.
PROCEDURE
- A Delinquent Notice will be mailed within 45 days to members who
don’t pay by July 31. - Accompanying all letters will be a list of approved resources and
agencies including financial budget and housing counselors. - Delinquent members cannot reserve use of the longhouse or park, vote
on matters that appear before the Association, and will lose their
Ainaloa mailbox privileges. - The delinquent member will be offered a Payment Plan. All payments
must be made within one year of the original date. - Full payment by the member at any stage of the collection process
nullifies all further penalties to that member. - If the delinquent member has not accepted a payment plan and has
not paid in full payment by September 15 th , a Third Delinquent Notice
will be mailed to that member. The Association may also refer the
delinquent member’s account to a collection agency. The Association
will record a lien against the delinquent member’s real property. - If the delinquent member has not accepted a payment plan and has
not paid full payment by January 31 st of the following year, a Final
Delinquent notice will be mailed by certified mail to that member. - If the Association’s attempts to collect assessments have failed,
foreclosure will be the final step.
